Penalties for a 2nd OUI in Boston

It’s not a surprise that the penalties for a second OUI or DUI conviction are more severe than those for a first-time OUI.   Although a 2nd OUI is still considered a misdemeanor offense, if you are found guilty of a second OUI/DUI you could be sentenced to the following penalties:

  • At least 60 days in jail, but not more than 2.5 years
  • Fines up to $10,000
  • License suspension for 1 year.  After one year you may be eligible for a hardship license
