License Suspension Hearings in Boston

If you have been arrested on OUI charges in Boston, there is a good chance your driver’s license will be suspended.  Like most people in Boston, your driver’s license probably means a lot to you.  Your license gives you the freedom to get to work, school, and other places of importance and interest without hassle or headache.  When you lose the right to drive due to an OUI/DUI conviction, you will quickly see how a license suspension can make your life much more difficult.

OUI License Suspension Hearings

Unfortunately, the possibility that your driver’s license will be suspended is the reality of any OUI case. When a person is arrested for OUI/DUI in Boston, not only will they need to fight their charges in criminal court, but they also have the option of challenging the suspension of their driver’s license at a hearing with the RMV.   If you have been arrested for OUI, you only have 15 days from the date of your arrest to schedule a hearing to fight the suspension of your driver’s license.  This hearing is conducted with the Registry of Motor Vehicles (RMV), and is a completely separate process than the criminal trial.  At the license suspension hearing, you and your attorney will have the opportunity to present your evidence, testimony, and arguments, as well as contest the evidence, testimony, and arguments being presented by the prosecution. If you are successful at the hearing, you will be given back your driver’s license.  However, if you lose at the hearing your license will be suspended for up to one year.

If your license remains suspended after your hearing, Boston OUI lawyer Thomas A. Brant can work with you to obtain a hardship license.  A hardship license gives you permission to drive for 12 hours a day, usually to places like work and school.
