Defense for Out-of-State OUI/DUI
Massachusetts is a member of the Non-Resident Violators Compact (NRVC). The NRVC is an agreement between member states to inform each other when a driver receives a traffic ticket or citation while visiting another state, but fails to respond to the ticket or citation (by not paying the ticket, failing to appear in court, etc.). If a driver fails to respond to their ticket, the state in which the offense occurred will notify the department of motor vehicles in the driver’s state of residence, which will then suspend the driver’s license until the driver takes care of his/her ticket. Even if a driver receives a traffic ticket in a state that is not a member of the NRVC, the authorities in both states are still likely to suspend a person’s driver’s license until the ticket has been resolved.
Out-of-State OUI/DUI Convictions
If you have a prior DUI/OUI conviction on your record from another state, the courts in Massachusetts can still consider your prior conviction when determining sentencing and penalties for an OUI conviction in Massachusetts. This makes a big difference in cases where a person is facing charges for a repeat offense, as the penalties are much harsher for a second, third, fourth, and fifth OUI offense.
